Bankruptcy
Chapter 7 Bankruptcy Document Preparation
What is Bankruptcy?
Bankruptcy is a federal court process that can help people get relief from debts they can't pay, either by wiping out certain debts or by repaying them through a court-approved plan. Bankruptcy cases for residents of San Diego and Imperial counties are filed with the U.S. Bankruptcy Court for the Southern District of California. The most common types for individuals are:
- Chapter 7 — a liquidation case that can discharge many unsecured debts, such as credit cards and medical bills. Eligibility depends in part on your income.
- Chapter 13 — a repayment plan, usually over three to five years, that lets you pay back some or all of your debts over time.
Documents We Prepare
SD Thrive Solutions prepares bankruptcy petition documents based on the information and direction you provide:
- Voluntary petition
- Schedules of your property, debts, income, and expenses
- Statement of financial affairs
- Means test forms
- Creditor mailing list in the court's required format
How We Can Help
How it works: You complete our questionnaire with your financial information, and we type your bankruptcy forms accurately and professionally for you to review and sign. We can also assist with:
- Organizing your pay stubs, tax returns, and statements into a complete package
- Preparing amended schedules if your information changes
- Making copies for your records
- Published information about the credit counseling and financial management courses the court requires
What We Don't Do
As a bankruptcy petition preparer under federal law (11 U.S.C. § 110), we can't tell you whether to file bankruptcy or which chapter to file, whether your debts will be discharged, what property you can keep or which exemptions to claim, or how filing will affect your home, car, taxes, or credit. We can't represent you in court or at your meeting of creditors. If you need that kind of guidance, we can point you toward a bankruptcy attorney or a State Bar-certified Lawyer Referral Service.
Our fee is disclosed in writing before we begin and is subject to review by the Bankruptcy Court. It does not include the court filing fee, which you pay directly to the court — contact us for a quote based on your situation.
